Welcome to It's Me. These Terms of Service ("Terms") govern your access to and use of our job search and recruitment platform, website, and related services (collectively, the "Platform"). The Platform is operated by It's Me ("we," "us," or "our").
By creating an account, browsing job listings, or otherwise using the Platform, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree to these Terms, please do not use the Platform.
You represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Platform, you affirm these representations.
To access certain features, you must create an account. You agree to:
We reserve the right to suspend or terminate accounts that contain false, misleading, or fraudulent information, or that violate these Terms.
The Platform serves two primary user roles, each with specific responsibilities:
It's Me is a platform that facilitates connections. We are not a party to any employment relationship, recruiting agreement, or contract between users. We do not employ, endorse, or guarantee any user on the Platform.
You agree not to misuse the Platform or engage in any conduct that could damage, disable, or impair the Platform. Prohibited activities include, but are not limited to:
You retain ownership of all content you post or upload to the Platform, including profile information, photos, video responses, resumes, messages, and job postings. By posting content, you grant It's Me a worldwide, non-exclusive, royalty-free, transferable license to host, store, use, display, reproduce, and distribute that content as necessary to operate and improve the Platform.
You represent and warrant that you have all necessary rights to the content you post and that it does not infringe the intellectual property or other rights of any third party.
We respect intellectual property rights and expect our users to do the same. We may remove content that we believe violates these Terms or applicable law, and we may terminate accounts of repeat infringers.
If you believe that content on the Platform infringes your copyright, you may submit a takedown notice under the Digital Millennium Copyright Act (DMCA). Your notice must include:
Submit DMCA notices through our Contact page. We will process and respond to valid notices in accordance with applicable law.
Employers who post jobs on the Platform are solely responsible for the content of their postings and for all hiring decisions. Employers agree to:
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, secure, error-free, or that defects will be corrected. We do not guarantee that you will find a job, a candidate, or any specific outcome from using the Platform.
We do not endorse, verify, or guarantee the accuracy of user profiles, job postings, or communications. You rely on all such content at your own risk.
Any reliance on information or content obtained through the Platform is at your own risk. We are not responsible for any damage to your device or loss of data resulting from your use of the Platform.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IT'S ME, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.
Our total aggregate liability for any claim arising from or related to the Platform shall not exceed the greater of (a) the amounts you have paid to us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless It's Me and its officers, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if they qualify. The arbitration shall be conducted in the United States, under the rules of the American Arbitration Association, by a single arbitrator.
There shall be no class or collective arbitration, and you waive any right to participate in a class action or class-wide arbitration.
The governing law shall be the laws of the State of Delaware, without regard to its conflict of laws principles. You and we agree to submit to the personal jurisdiction of the courts located in Delaware for any actions not subject to arbitration.
You agree that any claim or cause of action must be filed within one (1) year after it arose, or it is permanently barred.
We reserve the right to suspend, restrict, or terminate your access to the Platform at any time, with or without cause and with or without notice, if we believe you have violated these Terms, applicable law, or for any other reason we deem appropriate.
You may close your account at any time through your account settings or by contacting us. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall remain in effect.
The Platform may integrate with third-party services such as video conferencing for interviews, authentication providers, and analytics tools. Your use of these third-party services is subject to their own terms and privacy policies. We are not responsible for the practices or content of these third parties.
We may update these Terms from time to time. We will post the updated version here and revise the date at the top of this page. For material changes, we will provide notice through the Platform or via email. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
If you have questions about these Terms, please reach us through our Contact page. We are committed to addressing your concerns promptly and professionally.
